Este artículo presenta un análisis teórico de la incorporación del concepto de interseccionalidad en el discurso jurídico, para posteriormente, adentrarse al estudio de las iniciativas de norma constitucional que buscan consagrarlo en la propuesta de nueva Constitución de Chile.

Dentro del marco de la teoría de los ensamblajes formulada por Manuel De Landa, en este artículo se desarrollan los siguientes puntos: el esclarecimiento del concepto de ensamblaje, la explicación de su carácter histórico y la problematización de esta teoría a partir de su relación con la epistemología, la ética y la ontología. En la conclusión, se clarifica el concepto de materia presupuesto en esta filosofía. Además, se muestra brevemente cómo esta ontología plana se vincula con la filosofía política y, (...) de nuevo, con la epistemología. Problematizar la teoría de los ensamblajes, cuya fuente filosófica se encuentra en la obra de Gilles Deleuze y Félix Guattari, permite reconocer los alcances de una ontología que postula la existencia de un mundo compuesto de multiplicidades históricas y heterogéneas. Los estudios acerca de la Antigüedad, la Tardoantigüedad y el Medioevo que se ofrecen en este libro contemplan aspectos retóricos, filosóficos y culturales de tan dilatado período que se hallan atravesados por discursos y representaciones en torno a diversas instituciones y personalidades. Los trabajos reunidos en el volumen, lejos de pretender cerrar o encauzar una perspectiva de abordaje y un contenido específico, promueven la apertura de las reflexiones hacia distintas realizaciones o aportes, en el seno de las humanidades, que instalen (...) o, incluso, reinstalen los debates y las especulaciones investigativas.Dada la constelación de temas que surgen de título y subtítulo, la secuencia del libro es cronológica: inicialmente aparecen los capítulos que se ocupan de la Antigüedad grecorromana; a continuación, se ubican las colaboraciones dedicadas a manifestaciones tardoantiguas y medievales y, finalmente, cierra el recorrido un capítulo referido a una fuente filosófica del siglo XX que analiza las épocas que nos interesan. Sin embargo, el cúmulo de fuentes, temas, intereses y ópticas de interpretación puestos en juego permitirá al lector otras formas de agrupación de los capítulos, a la hora de asignar un sentido global al libro, que darán cuenta, sin duda, de una hermenéutica más compleja que la mera sucesión temporal de los textos y discursos a los que cada una de las secciones se aplica. The autopoietic theory and the enactive approach are two theoretical streams that, in spite of their historical link and conceptual affinities, offer very different views on the nature of living beings. In this paper, we compare these views and evaluate, in an exploratory way, their respective degrees of internal coherence. Focusing the analyses on certain key notions such as autonomy and organizational closure, we argue that while the autopoietic theory manages to elaborate an internally consistent conception of living beings, the (...) enactive approach presents an internal tension regarding its characterization of living beings as intentional systems directed at the environment. This work has transformed the field into a flourishing and increasingly influential discipline. No one has played a greater role in this development than Viviana Zelizer, one of the world's leading sociologists. Building on the original formulation of the autopoietic theory (AT), extended enactivism argues that living beings are autopoietic systems that extend beyond the spatial boundaries of the organism. In this article, we argue that extended enactivism, despite having some basis in AT’s original formulation, mistakes AT’s definition of living beings as autopoietic entities. We offer, as a reply to this interpretation, a more embodied reformulation of autopoiesis, which we think is necessary to counterbalance the (excessively) disembodied spirit of AT’s original (...) formulation. The article aims to clarify and correct what we take to be a misinterpretation of AT as a research program. AT, contrary to what some enactivists seem to believe, did not (and does not) intend to motivate an extended conception of living beings. AT’s primary purpose, we argue, was (and is) to provide a universal individuation criterion for living beings, these understood as discrete bodies that are embedded in, but not constituted by, the environment that surrounds them. However, by giving a more explicitly embodied definition of living beings, AT can rectify and accommodate, so we argue, the enactive extended interpretation of autopoiesis, showing that although living beings do not extend beyond their boundaries as autopoietic unities, they do form part, in normal conditions, of broader autopoietic systems that include the environment. The quest for real democracy is one of the components of sustainable degrowth. But the incipient debate on democracy and degrowth suffers from general defi-nitions and limited connections to political philosophy and democracy theory. This article offers a critical review of democracy theory within the degrowth literature, taking as its focal point a relevant debate between Serge Latouche and Takis Fotopoulos. We argue that the core of their contention can be traced back to the relationship between the concepts of democracy (...) and autonomy as defined by philosopher Cornelius Castoriadis, which both authors and generally the degrowth movement consider as one of their theoretical reference points. We show how both Latouche and Fotopoulos hold a misconception of Castoriadis’ notions of autonomy, the social imaginary and politics, which in turn limits their cognisance of democracy and hence confuses their debate concerning the possibilities for a degrowth transition within the confines of a liberal parliamentary democracy. With a clarified theoretical understanding of the interconnected democracy-autonomy assemble, we proceed to an evaluation of the revolutionary potential of the degrowth movement and to a better understanding of a possible relationship between democracy and degrowth. This article examines corporate social responsibility (CSR) through the lens of political ontology. We contend that CSR is not only a discursive mean of legitimization but an inherently ontological practice through which particular worlds become real. CSR enables the politics of place-making, connecting humans and nonhumans in specific territorial configurations in accordance with corporate needs and interests. We discuss three CSR mechanisms of singularization that create a particular corporate ontology in place: (1) community engagements that form ‘stakeholders’; (2) CSR standards (...) and certifications that produce singular sustainable environments; and (3) CSR reporting that erases ontological conflicts and enables the singularized representation (of the environment and the community) to travel to other locations of the corporate world. We argue that these ontological CSR practices obscure the pluriverse of other world and place-making practices that would create different kinds of sustainabilities based on less extractive and non-corporate ways of being in place. This paper examines a fundamental philosophical difference between two radical postcognitivist theories that are usually assumed to offer the same view of cognition; namely the autopoietic theory and the enactive approach. The ways these two theories understand cognition, it is argued, are not compatible nor incompatible but rather incommensurable. The reason, so it is argued, is that while enactivism, following the traditional stance held by most of the cognitive theories, understands cognitive systems as constituting a natural kind, the autopoietic theory (...) understands them as constituting only a conventional kind. Additionally, the paper shows that AT’s conventionalist stance about cognition, far from being an undesirable or useless position, offers some methodological virtues that might be timely and welcome in the agitated and revolutionary climate of current cognitive science. Research traditions on cognition and depression focus on relatively unconnected aspects of cognitive functioning. On one hand, the neuropsychological perspective has concentrated on cognitive control difficulties as a prominent feature of this condition. On the other hand, the clinical psychology perspective has focused on cognitive biases and repetitive negative patterns of thinking for emotional information. A review of the literature from both fields reveals that difficulties are more evident for mood-congruent materials, suggesting that cognitive control difficulties interact with cognitive biases (...) to hinder cognitive switching, working memory updating, and inhibition of irrelevant information. Connecting research from these two traditions, we propose a novel integrative cognitive model of depression in which the interplay between mood-congruent cognitive control difficulties, cognitive biases, and rumination may ultimately lead to ineffective emotion-regulation strategies to downregulate negative mood and upregulate positive mood. This article analyzes the legal-philosophical situation of Artificial Intelligence and the intelligent robot on being a subject of Law to be considered a creative person or author. The contradiction involved in allowing an object to present the legal duality of being protected as an object that it is and at the same time being considered a subject by the resulting work is analyzed, an impairment or vulgarization for the subject of Law as a moral subject when proposing the fictio legis (...) de a moral object, which is not conceivable. Instead, an alternative to such an aporia is proposed, more fictitious than real. (shrink)

In this paper we will demonstrate that a computational system can meet the criteria for autonomy laid down by classical enactivism. The two criteria that we will focus on are operational closure and structural determinism, and we will show that both can be applied to a basic example of a physically instantiated Turing machine. We will also address the question of precariousness, and briefly suggest that a precarious Turing machine could be designed. Our aim in this paper is to challenge (...) the assumption that computational systems are necessarily heteronomous systems, to try and motivate in enactivism a more nuanced and less rigid conception of computational systems, and to demonstrate to computational theorists that they might find some interesting material within the enactivist tradition, despite its historical hostility towards computationalism. En esta breve reflexión nos centraremos en dos aspectos de la frase poética, el primero es el ritmo y el segundo, la metáfora. Nos referiremos al ritmo como imagen, musicalidad y sentido que trasciende la métrica, y a la metáfora como figura de pensamiento y vehículo para ingresar en una nueva percepción del mundo. El análisis de estos dos elementos propicia un acercamiento hermenéutico al poema como un devenir.

Aristóteles ocupa un lugar muy destacado en la historia de la reflexión filosófica sobre las emociones. A pesar de la innumerable variedad de interpretaciones a las que el estudio de este tema en su pensamiento ha dado lugar en las últimas cuatro décadas, prácticamente no se ha considerado el papel y la importancia que la habituación emocional tiene en el programa educativo musical del mejor régimen, el cual Aristóteles bosqueja en el último libro de la Política. Precisamente, el propósito del (...) presente artículo es analizar el proceso emocional que esta disciplina pone en juego y determinar cuál es su propósito ético-político. La función ética de la mousiké permite el desarrollo de la virtud por medio de un proceso de habituación de los niños, el cual se sustenta en la influencia emocional que caracteriza esta disciplina. Mediante el análisis de los dos breves pasajes en los que Aristóteles alude a la influencia emocional de la mousiké y la consideración de las referencias etnográfico-musicales tácitas y explícitas que aparecen en Política VIII 5-7 intentaré mostrar que esta función musical apunta a lograr el control de las emociones de los ciudadanos durante su infancia y su “curación” en la vida adulta. Context: The majority of contemporary enactivist work is influenced by the philosophical biology of Hans Jonas. Jonas credits all living organisms with experience that involves particular “existential” structures: nascent forms of concern for self-preservation and desire for objects and outcomes that promote well-being. We argue that Jonas’s attitude towards living systems involves a problematic anthropomorphism that threatens to place enactivism at odds with cognitive science, and undermine its legitimate aims to become a new paradigm for scientific investigation and understanding of (...) the mind. Problem: Enactivism needs to address the tension between its Jonasian influences and its aspirations to become a new paradigm for cognitive science. By relying on Jonasian phenomenology, contemporary enactivism obscures alternative ways in which phenomenology can be more smoothly integrated with cognitive science. Method: We outline the historical relationship between enactivism and phenomenology, and explain why anthropomorphism is problematic for a research program that aspires to become a new paradigm for cognitive science. We examine the roots of Jonas’s existential interpretation of biological facts, and describe how and why Jonas himself understood his project as founded on an anthropomorphic assumption that is incompatible with a crucial methodological assumption of scientific enquiry: the prohibition of unexplained natural purposes. We describe the way in which phenomenology can be integrated into Maturana’s autopoietic theory, and use this as an example of how an alternative, non-anthropomorphic science of the biological roots of cognition might proceed. Results: Our analysis reveals a crucial tension between Jonas’s influence on enactivism and enactivism’s paradigmatic aspirations. This suggests the possibility of, and need to investigate, other ways of integrating phenomenology with cognitive science that do not succumb to this tension. Implications: In light of this, enactivists should either eliminate the Jonasian inference from properties of our human experience to properties of the experience of all living organisms, or articulate an alternative conception of scientific enquiry that can tolerate the anthropomorphism this inference entails. The Maturanian view we present in the article’s final section constitutes a possible framework within which enactivist tools and concepts can be used to understand cognition and phenomenology, and that does not involve a problematic anthropomorphism. Constructivist content: Any constructivist approach that aims for integration with current scientific practice must either avoid the type of anthropomorphic inference on which Jonas bases his work, or specify a new conception of scientific enquiry that renders anthropomorphism unproblematic. Many current problems surrounding science revolve around the complex epistemological framework that shapes a new vision of knowledge about reality. The traditional epistemological positions are characterized by the explanation of nature by means of concatenated facts; that is, as bricks attached to each other giving shape to the edifice of science. A conception of this nature showed that the idea of certainty was nothing more than a mere illusion, opening the way, on the contrary, to the idea of the uncertainty (...) of knowledge based on the descriptions of quantum physics, also a product of the non-reductionist conception of reality, thus criticizing the specular representation. This article addresses the main problems surrounding the critical conceptions that the emerging epistemology reveals about knowledge, pointing towards a much more complex vision of reality. (shrink)

Se analizan los desafíos de futuro de la sociedad digital. Desde perspectiva fenomenológico-hermenéutica, la idea de una ética de la tecnología considera la sociedad digital como dispositivo técnico. La literatura pertinente permite, primero, estudiar la tecnología disruptiva como generadora de cambios sociales, los cuales, a su vez, transforman las formas de la facticidad de la vida. De esta manera, la ética de la sociedad material, sirve de argumento para analizar la ética en la sociedad digital. Tomando la bioética filosófica como (...) instrumento, se concluye que la sociedad digital antepone retos para la vida, los cuales debe afrontar para la supervivencia. (shrink)

The Aristotelian praise of the contemplative life in Nicomachean Ethics X was very influential in the history of philosophy and its effects go much more beyond the limits of Hellenism and Late Antiquity. Although, it is in Politics VII 1-3 where Aristotle presents the more detailed consideration of the ways of life, in particular, the opposition between the political and philosophical life. The purpose of this work is to reconsider the praise of the contemplative life at the end of NE (...) and to recover the political significance that the ethical preface that precedes the design of the ideal polis has in this discussion in order to show the correspondence that exists between the redefinition of praxis in Pol. VII 3 and the hierarchy of eudaimonia in NE X 7-8. (shrink)

This article addresses, experimentally, the question of how presuppositions are cognitively processed and retrieved in discourse. In the proposed research, we have administered tweets produced by Italian politicians to native speakers so as to assess how easily they could retrieve the presupposed content of two presupposition triggers (definite descriptions and change of state verbs), as opposed to their explicit paraphrase, by answering verification questions. Results showed that content presupposed by change of state verbs was likely to receive more attention than (...) content conveyed by definite descriptions; this could possibly be due to the greater effort involved in mentally representing the event taken for granted by the predicates. Definite descriptions, on the contrary, seem to instruct to a shallower processing modality, which means that their content is processed less attentively or in a ‘good-enough’ way. (shrink)

Las estrategias de adquisición léxica implementadas en formato multimedia han sido poco estudiadas, especialmente las que se utilizan en documentos diseñados para estudiantes en nivel preescolar. El objetivo de este artículo es identificar estrategias de adquisición léxica presentes en el documento digital que complementa al libro de texto de inglés para Kínder “Calibot 2”, único en su tipo de editorial chilena. Para esto, se llevó a cabo un estudio cualitativo de diseño análisis documental a la luz de la propuesta de (...) Nation (2007) conocida como las Four strands o cuatro hebras a partir de la que se levantaron categorías de análisis que fueron aplicadas por medio del software Nvivo12. Se encontraron 11 estrategias de adquisición léxica presentadas de forma multimedia que apoyarían la adquisición efectiva de léxico en una L2. Si bien los resultados aportan al ámbito pedagógico al promover el conocimiento de estrategias de adquisición léxica de L2 que pueden ser implementadas en formato multimedia, la presencia de estas estrategias se limita al documento analizado y sus resultados no pueden ser generalizados. Questo studio investiga quali siano i punti di contatto tra il filosofo tedesco Friedrich Nietzsche e lo scrittore svedese Hjalmar Söderberg nel romanzo di quest’ultimo Doktor Glas. L’articolo prende in esame due testi nietzschiani finora poco messi in relazione con l’opera söderberghiana, Über Wahrheit und Lüge im außermoralischen Sinne e Die fröhliche Wissenschaft, evidenziando gli influssi che il pensiero del filosofo tedesco ha esercitato sulla concezione del Doktor Glas. L’analisi prende le mosse dai concetti di menzogna e conoscenza così come (...) formulati in Über Wahrheit und Lüge im außermoralischen Sinne e dal concetto di “morte di Dio”, identificando in quest’ultimo il crollo della metafisica nel pensiero filosofico europeo a partire dalla rivoluzione copernicana. Il saggio illustra come a questo cambiamento sia sopraggiunto lo svilupparsi di una nuova sensibilità tecnico-scientifica legata alla physis, cambiamento che vede nella figura del medico il suo massimo esponente. L’articolo mette dunque in luce come nel Doktor Glas il passaggio dalla metafisica alla physis venga rappresentato come un momento di crisi esistenziale, non avendo il medico la capacità di superare il trauma della perdita della metafisica. Quest’incapacità è causata dalla conoscenza, la quale se offre la possibilità di scoprire le menzogne usate dalla società, non consente però di trovare lo stimolo per superare la condizione di vuoto causata dalla “morte di Dio”. Söderberg fornisce dunque nel suo romanzo un’interpretazione pessimistica della crisi di Fin de siècle, inquadrando nella paralisi interiore del dottor Tyko Gabriel Glas e l’omicidio inconcludente del pastore Gregorius il fallimento del passaggio dal paradigma metafisico al paradigma della physis e l’impossibilità di superare la crisi tramite una metamorfosi nella condizione di Übermensch. El artículo se propone caracterizar la Extensión Crítica, como una alternativa modalidad emergente, desde una perspectiva epistemológica. Caracteriza al conocimiento propio de la misma como orientado por un interés emancipador, lo que supone procesos de autorreflexión, concientización, crítica ideológica y praxis. Es un conocimiento práctico para la acción y que se construye en y desde la acción. Su modo de producción propone una epistemología que reconoce al otro como sujeto cognoscente y legitima reflexivamente sus saberes silenciados, proponiendo incluir el punto (...) de visa de los excluidos y, por lo tanto, una epistemología extendida, que articula conocimientos experienciales, proposicionales, representacionales y prácticos, así como científicos, populares, cotidianos y nativos. La complejidad de los problemas socio-políticos abordados desde la Extensión Crítica interpela a abordajes interdisciplinares y a la conformación de comunidades de prácticas. Finalmente, se proponen otros criterios de validación de este tipo de conocimiento, diferentes a los considerados en el campo de la extensión clásica: validez comunicativa, operatividad pragmática, empoderamiento, congruencia entre diferentes tipos de conocimiento y credibilidad. Este trabajo se enmarca dentro del análisis de las acciones alternativas a la privación de libertad en adolescentes infractores a la ley penal. Intenta buscar soluciones que eviten la cárcel para quienes cometan pequeños delitos, opción que puede disminuir el índice de reincidencias. El objetivo es promover, desde el Trabajo Social, una doble reflexión: primero, analizando críticamente el concepto de delito, su definición en las diversas corrientes ideológicas y su aplicación en la legislación argentina; y segundo, la importancia de que (...) los jóvenes se responsabilicen de sus actos y experimenten caminos alternativos al delito.This work places inside the analysis of the alternative actions to the privation of freedom in inobservant teenagers to the penal law. It tries to look for solutions that avoid the jail for those who commit small crimes, option that can diminish the index of repetitions. The aim is to promote, from the Social Work, a double reflection: first, analyzing critically the concept of crime, his definition in the diverse ideological currents and his application in the argentine legislation; and second, the importance of which the young men take responsibility of his acts and experience alternative ways to the crime. Within the framework of the assemblage theory formulated by Manuel De Landa, in this article, we develop the following points: the definition of the concept of assemblage, the explanation of its historical character and the problematization of this theory from its relation with epistemology, ethics, and ontology. In addition, we show briefly how this flat ontology is linked to political philosophy and, again, to epistemol-ogy. Problematizing the assemblage theory, whose philosophical source is in Deleuze and Guattari’s work, allows us to (...) recognize the scope of an ontology that postulates the existence of a world composed of historical and heterogeneous multiplicities. To conclude, we clarify the concept of matter underlying this philosophy. (shrink)

My paper proposes the concept of relational work to explain economic activity. In all economic action, I argue, people engage in the process of differentiating meaningful social relations. For each distinct category of social relations, people erect a boundary, mark the boundary by means of names and practices, establish a set of distinctive understandings that operate within that boundary, designate certain sorts of economic transactions as appropriate for the relation, bar other transactions as inappropriate, and adopt certain media for reckoning (...) and facilitating economic transactions within the relation. I call that process relational work. After identifying specific elements of a relational work approach, the paper focuses on the case of monetary differentiation. It compares a relational work theory of earmarking money with behavioral economics’ individually based mental accounting approach. (shrink)

The European framework surrounding clinical trials on medicinal products for human use is going to change as demonstrated by the large debate at European institutional level. One of the major challenges is to overcome the lack of harmonisation of clinical trial procedures among countries. This aspect is gaining more and more importance, considering the increasing number of multicentre and multinational studies. In this work, the actual European rules governing the Clinical Trial Application have been analysed throughout the different steps including (...) the registration of the trial in the European database; the preparation of documents to be submitted and their contents; the preparation of documents related to the information and consent process; the submission to competent bodies. Specific issues related to paediatric research and trials involving non EU/EEA countries have been addressed as well. Results reveal that the European legislation offers a well defined set of European rules covering different aspects of a Clinical Trial Application. However, these are not suitable to meet the challenges from multicentre and multinational clinical studies. A stronger set of rules, such as is available in a composite European Regulation has been adopted and is expected to harmonise practices and enable sponsors to carry out well conducted trials. But will the new regulation overcome the existing criticisms of Directive 2001/20/EC? (shrink)

This paper reports the framework, method and main findings of an analysis of cultural milieus in 4 European countries. The analysis is based on a questionnaire applied to a sample built through a two-step procedure of post-hoc random selection from a broader dataset based on an online survey. Responses to the questionnaire were subjected to multidimensional analysis-a combination of Multiple Correspondence Analysis and Cluster Analysis. We identified 5 symbolic universes, that correspond to basic, embodied, affect-laden, generalized worldviews. People in this (...) study see the world as either a) an ordered universe;b) a matter of interpersonal bond;c) a caring society;d) consisting of a niche of belongingness;e) a hostile place. These symbolic universes were also interpreted as semiotic capital: they reflect the capacity of a place to foster social and civic development. Moreover, the distribution of the symbolic universes, and therefore social and civic engagement, is demonstrated to be variable across the 4 countries in the analysis. Finally, we develop a retrospective reconstruction of the distribution of symbolic universes as well as the interplay between their current state and past, present and future socio-institutional scenarios.
